Shitty experience with a BX, BEWARE

Dear BXproject counsellors, hear my sad story.

A while ago I enquired of a chap on the BX club forum about buying his BX 16v track car. A deal was struck and half the cost of the car was paid (more fool me). Fast forward a few weeks and I get some more emails and pissed off phone calls from the guy saying that he wants the rest of the money or he will "consider that I no longer require the car". Since then I've had no contact from him despite emails, calls etc, and the car that I have already paid for half of has appeared again on ebay here:

Since this is the forum where it's allowed, let me say: CUNT.

Needless to say, if you are ever thinking of dealing with this chap (Brian Pollard, aka Brian Buckingham) then don't. Now off to call my solicitor :(

He's now banned and blocked from BXC (and I'm certain Vanny has done the same here) but he has been discussed before. I didn't have any issues with him, but looks like he's back to his old tricks again. I want to go round there with a trailer in the dead of night and take it for you!

I've put markers on his IP addresses, but not banned him her and on the 16v forum. The admin team have been informed about his practices on the 16v forum, but as he hasn't actually tried to access the account or view the site for a long long long time, i haven't banned him yet. I'd rather he turned up, everyone spoke there mind, then ban him. Childish and pathetic, and not worth the many £ djoptix has spent, but mildly satisfying.

I'm glad to see he's going to make a HUGE profit on his current eBay listing.

djoptix, have you looked into the legal aspects? A deposit suggests a legal contract of sales. I suspect a call to Anglesey Trading Standards could be interesting? I would hazard a guess that the car is registered in the 'business' name, and thus a business asset, so technically sold by the company.

Brian has sent an email to the admin on BXC. Atempting to paint a rather different story, not that I'm buying it, too much previous to say different, and whilst I've not actually met MR. Optix I've conversed with him in the past so I know the score..

I got a phone call from him last night. Given that I was not in the best of moods at the time, and was shouting/swearing at even inanimate objects, he really did pick his time very well! :lol: Image

Have you got anything in writing (email or other) that confirms your deposit for the car?

That forms a contract of sale. Given that the time elapsed is very short between your payment and the car appearing on eBay I think that could constitute a breech of contract.

I wouldnt arse about with solicitors I would just file a small claim at the local courts and let them get on with it. Should he not turn up at the court (and he doesnt have to, he can argue his side by letter) and they find in your favour (not guaranteed, but if what you say is correct its probable) then the court will write to him and ask him to pay them (not you) and any associated costs you can prove (time, phone calls, printing etc). Obviously if he ignors this it will be sent on to a debt collection agency (who will add their own fees) and possibly bailifs (who add in even more).

A couple of us could just go for a "chat" with him and retrieve said cash at same time.

Either that or I bring an AK47 back from Libya, there are plenty about there. :P

actually, getting a decommisioned gun through customs isn't that hard if you have the paperwork for it, and any half decent machinist can recommision one..
